This Domain Name Agreement (“Agreement”) is made between MightyWeb (“we,” “our,” “us”) and the client (“you,” “your,” “client”) who purchases or transfers a domain name through our services.
By purchasing or transferring a domain name with MightyWeb, you agree to the following terms and conditions.
Domain Name Registration and Ownership
1.1 Registration
When you purchase or transfer a domain name through MightyWeb, we will facilitate the registration process with Enom, an accredited domain registrar. Once registered, you are the legal owner of the domain name, and you will have the right to use it according to the terms of the domain registry.
1.2 Domain Ownership and Control
Although MightyWeb facilitates the registration and management of the domain name, the ownership of the domain remains with you. You are responsible for ensuring the domain name is used in compliance with all applicable laws, regulations, and the policies of the domain registrar and registry.
1.3 Domain Name Transfer
If you wish to transfer the domain to another registrar or owner, you must notify us and follow the domain registrar’s transfer process. You may be required to unlock your domain or provide authorization codes for the transfer. Any fees or requirements for transferring the domain will be your responsibility.
Payment and Renewal
2.1 Payment
You agree to pay all fees associated with the registration, renewal, or transfer of the domain name. These fees must be paid in full prior to the registration or renewal of your domain. MightyWeb will not be responsible for any payment delays or failure to renew the domain.
2.2 Domain Name Renewal
It is your responsibility to ensure that your domain name is renewed in a timely manner. MightyWeb will notify you of upcoming domain name renewal dates. Additionally, you may receive email reminders from Enom, the registrar, about renewal deadlines. Failure to renew the domain name before the expiration date may result in the suspension or loss of the domain name. We may offer assistance with renewing your domain, but the final responsibility for renewal rests with you.
2.3 Auto-Renewal
We recommend setting your domain name to auto-renew to prevent accidental lapses in service. If auto-renewal is not enabled, you are responsible for ensuring timely renewal. MightyWeb will not be held responsible for any domain loss or suspension due to failure to renew.
Domain Name Privacy
3.1 WHOIS Information
The domain registrar may require you to provide accurate personal information, including your name, email address, physical address, and phone number for the public WHOIS directory. During the domain registration process, you have the option to opt in for domain privacy protection, which will help keep your personal information private by substituting it with the registrar's contact details in the WHOIS directory.
3.2 Privacy Protection
If you choose to purchase domain privacy protection, MightyWeb will assist in enabling this service for your domain. If you opt-out of privacy protection, your personal details will be publicly available in the WHOIS directory. It is your responsibility to ensure that the privacy protection option remains enabled if you wish to keep your information private.
Expired Domain Names and Redemption Fees
4.1 Expiration and Redemption
If your domain name expires, it may enter a grace period or redemption period, depending on the specific TLD (Top-Level Domain) of the domain. If the domain is not renewed within the grace period, it will be subject to redemption fees. These fees vary depending on the domain's TLD, and the redemption process may involve additional costs and steps to recover the expired domain. You are responsible for all redemption fees if applicable.
4.2 Domain Deletion
If a domain is not renewed or recovered during the redemption period, it will be permanently deleted and may no longer be recoverable. MightyWeb is not responsible for any loss of domain data or content resulting from the deletion of expired domains.
Suspension and Termination
5.1 Suspension
Your domain name may be suspended if payment is not received, if there is a dispute regarding domain ownership, or if the domain is found to violate any terms of this Agreement or applicable law.
5.2 Termination
If the domain name is not renewed or if you decide to cancel it, the domain name will be permanently deleted and may no longer be recoverable. We are not responsible for any loss of domain data or content that results from termination.
Limitation of Liability
MightyWeb is not responsible for any loss, damage, or costs arising from issues related to domain registration, transfer, suspension, or termination. We are not liable for any interruptions to your domain service or any potential financial or reputational harm caused by the loss of the domain name.
Amendments to this Agreement
MightyWeb reserves the right to update or modify this Agreement at any time. Any changes will be posted on this page, and the effective date will be updated accordingly. You are responsible for reviewing this Agreement regularly to stay informed of any changes.
Governing Law
This Agreement will be governed by the laws of Pennsylvania, and any disputes arising under or related to this Agreement will be resolved in the appropriate courts in Pennsylvania.
