Welcome to MightyWeb! These Terms of Service (“Terms”) govern your access to and use of our web design and web hosting services. By engaging with us, you agree to these Terms.
Web Design Services
1.1 Service Agreement
Upon initiating a project with MightyWeb, you will receive an official proposal and a small agreement that outlines the scope of work, project details, and pricing. This proposal is subject to change based on your needs and requirements, and it must be signed by both parties to initiate the project.
1.2 Payment Terms
A 30% down payment of the total quoted or proposed price is required before any work begins on your website design. This down payment secures your project and commits the timeline. The remaining balance is due upon project completion before the final website is launched.
1.3 Additional Work
If you require additional work after the initial website is completed, we charge an hourly rate of $80/hour, or we may agree to a flat rate for any extra services requested. This work may include, but is not limited to, design revisions, feature enhancements, or new content updates.
1.4 Domain and Hosting
Domain name registration and web hosting are not included in the initial web design quote. You may either provide your own domain name and hosting services, or MightyWeb can assist with domain registration and hosting setup. Any costs associated with domain and hosting will be charged separately.
Monthly Website Maintenance and Support
As an add-on to our hosting plans, we offer a Monthly Website Maintenance and Support service for $50/month. By subscribing to this service, you will receive ongoing monthly website maintenance and support for your website, which includes the following:
- Weekly Website Updates: Regular updates to the website platform and its components.
- Weekly Theme and Plugin Updates: Ensuring that all themes and plugins are up-to-date for security and functionality.
- Error and Bug Fixes: Addressing any issues or bugs caused by the website platform, extensions, or themes.
- Free 1 Hour of Monthly Consultation: You will be entitled to one (1) hour of phone or video consultation per month to discuss your website’s performance, functionality, and receive guidance on improving your site.
Please note: This service does not include the creation of new pages, updating or editing existing pages, or redesigning website sections or layouts. Any additional requests beyond the scope of the above-mentioned services will be billed separately.
By subscribing to this add-on service, you acknowledge that the above services will be provided on an ongoing monthly basis for the agreed-upon fee.
Hosting Services
2.1 Auto Payment Requirement
All hosting services provided by MightyWeb must be set to auto payment with a valid credit card on file. This ensures that your hosting service remains active without interruptions.
2.2 Hosting Service Suspension and Termination
If a hosting service is not renewed by the due date, it will be suspended immediately. If payment is not received within 7 days after the suspension, your hosting account will be permanently terminated. Once terminated, we are unable to restore any data or reactivate the service, even if the overdue invoice is paid.
2.3 Monthly Maintenance and Support
MightyWeb offers optional monthly website support and maintenance services to help ensure that your website stays up-to-date, secure, and functional. These services are available for an additional fee and are only provided if you are using our hosting services. Support and maintenance packages can be customized based on your specific needs.
General Terms
3.1 Customer Responsibilities
You are responsible for ensuring the accuracy, legality, and completeness of all content provided to us for your web design project. MightyWeb is not responsible for any content that infringes on intellectual property rights or violates any applicable laws.
3.2 Cancellation and Refund Policy
Once the project has begun and the down payment has been made, cancellations are subject to a cancellation fee, and we reserve the right to keep any payments made for work completed up to that point. We do not offer refunds for completed work or services that have been initiated.
3.3 Changes to Terms
MightyWeb reserves the right to update or modify these Terms at any time. Any changes will be posted on this page, and the effective date will be updated accordingly. You are responsible for reviewing these Terms regularly to stay informed of any changes.
3.4 Limitation of Liability
MightyWeb will not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profit, data, or business interruption, arising from the use of our services. Our liability is limited to the total amount paid by the client for the services that are directly related to the issue at hand.
3.5 Governing Law
These Terms will be governed by and construed in accordance with the laws of Pennsylvania, and any disputes will be subject to the exclusive jurisdiction of the courts in Pennsylvania.
3.6 Service Agreement Termination
Either party may terminate the Service Agreement with 30 days written notice if the other party fails to meet its obligations. In the event of termination, the Client will be responsible for payment for all work completed up to the termination date.
